MOET to remove and simplify 51.9% business conditions
The Ministry of Education & Training (MOET) plans to remove and simplify 110 business conditions under the Ministry`s administration, equaling 51.9% of the current business conditions.
Under the Decree No.46 on 2017 prescribing regulatory requirements for educational investment and operation, the MOET proposed to remove 72 business conditions and simplifying 22, announced the Ministry.
Specifically, MOET suggested to remove requirements on establishing public kindergarten, preschools and nursery schools, primary schools, middle schools, high schools, foreign language and computer training centers, which are "consistent with the local socio-economic and educational network development plan approved by the state regulatory authority."
This is due to the fact that the network development plan in subject has been abolished in the 2017 Law on Planning.
Concurrently, the requirement of having "the decision on establishment or approval of establishment of the school", along with "employ an adequate staff of administrative officers, teachers and employees that are structured in a proper manner" will be removed.
The MOET also plans to remove condition of "maintain an sufficient amount of financial resources as required by laws in order to ensure continued operation and development of educational activities," due to the lack of specific requirements.
With regard to early childhood education, MOET proposed to remove "The proposal for establishment of a kindergarten, preschool or nursery school must clearly define preschool objectives, missions, curriculum framework and outline; land, facilities, equipment and intended construction site; organization and personnel structure, financial and other resources; guidelines and strategies for construction and development"; "must be located within the precincts of a residential zone in conformity with the general planning and at a place convenient for children to reach."
Another requirement of "have the statutes of organization and operations of the kindergarten, preschool or nursery school" is also removed.
Some others also under consideration to remove, such as "meet child daycare demands of families"; "a sufficient amount of personal care supplies for children";
At middle school, condition of "educational program and teaching or learning materials must be appropriate for primary education activities" will be removed.
In term of foreign language and computer training center, MOET suggested to remove "The average number of teachers must be 25 students/1 teacher/shift", "offices for the administrative mechanism according to the organizational structure of the center which are used for performing management and training tasks", " have libraries, facilities used for laboratory, practice and internship and other facilities that meet requirements of the training program, scientific and technological operations".
In Decree No. 73 dated 2012 on the foreign cooperation and investment in education, MOET proposed to remove condition that "The projects of investment in establishing higher education institutions must reach at least VND150 million (US$6,577) per student"; "A foreign-capitalized educational institution that applies for 20 years of operation or more in Vietnam must make a plan on building their facilities, and the land transfer or lease must be approved by a provincial People's Committee"; abolishing requirement that The foreign teachers and lecturers teaching in short-term training institutions, preschool education institutions, compulsory education institutions, vocational education institutions, and higher education institutions capitalized by foreign partners must have at least 5 years of experience in the disciplines that they teach."
The MOET also proposed of not having particular investment certificate for each kind of educational institution, or for establishing campuses of educational institution.
