The MoJ is the host agency to tackle disputes with foreign investors when they sue the Vietnamese Government based on the investment protection agreement.
The Ministry of Finance will solve disputes related to loans and debts of the Government and guaranteed by the Government.
Intentional investment disputes are emerging when foreign investors sue Viet Nam’s Government and State or authorized State agencies and organizations based on:
The agreement on investment encouragement and protection, trade agreements or international treaties on investment encouragement and protection, to which Viet Nam is a member, stipulating the settlement of disputes between foreign investors and the Vietnamese Government at international arbitration or authorized foreign jurisdiction agencies; or
Contracts and agreements between the Vietnamese Government or State agencies and foreign investors, which have regulations stipulating agencies to deal disputes arising from these contracts and agreements are international arbitration or authorized foreign jurisdiction agencies.
